Categories of Immigrant Visas

Persons immigrating to the United States are divided by U.S. immigration law into two general categories:

  1. those who may obtain legal permanent residence status without numerical limitation immediate relatives of a U.S. citizen and returning residents
  2. those who are restricted by an annual limitation on the number of persons who may enter as permanent residents. The latter category is further divided into:

In general, in order to be eligible to apply for an immigrant visa, a foreign citizen must be sponsored by a U.S. citizen relative(s) or by a prospective employer. Unlike most other immigrant categories, Immediate Relatives are not subject to numerical limits under immigration law. Additionally the Diversity Visa Program provides a certain number of permanent resident visa annually.
