Immediate Relatives

Immediate relatives of U.S. citizens include:

  • the spouse and minor (under 21 years old) unmarried children of a U.S. citizen
  • the parents of a U.S. citizen who is over the age of 21.

There is no limit on the number of visas that may be issued each year to this category of immigrants.

Since August 15, 2011, petitioners residing overseas are no longer able to routinely file Forms I-130,Petitions for Alien Relative, with U.S. Embassies and Consulates.  Petitioners residing in Belgium and Luxemburg are required to file their Forms I-130 by mail with the USCIS Chicago lockbox:

Exceptional I-130 filing at the U.S. Consular Section in Brussels: 
Beginning August 15, 2011, petitioners residing in Belgium,who believe that their situation merits an exception, may request an exception to allow the Consular Section in Brussels to accept the filing.  Each request for an exception will be evaluated individually. A petitioner seeking to file a Form I-130 (201KB - PDF) in Brussels should contact the Consular Section to request consideration of the request for exception and explain the circumstances in detail.  The Consular Section will then relay the request for an exception to the USCIS field office with jurisdiction over the Consulate.  The determination of whether the case presents exceptional circumstances that warrant an exception to the general filing process will be made by USCIS.  For guidance on what an exceptional circumstance may be, please check the USCIS website.

I-360 Filing at the U.S. Consular Section in Brussels:

Certain self-petitioning widows of U.S. citizens may file form I-360 at the Consular Section in Brussels.  An appointment is required to file the petition.  To schedule an appointment,  please call 02.811.42.00 on Mondays, Wednesdays and Fridays, between 2:00 and 3:30 p.m.

ATTENTION: The deadline for self-petitioning widows of U.S. citizens married less than 2 years whose spouses died before October 28, 2009 to file an I-360 self petition is October 28, 2011.  After that date, all widow(er)s will need to file within 2 years of the death.  The special transition period for old widow(er) cases where the death occurred at any time in the past also expires October 28, 2011 (for example, a widow(er) married in 1989 whose spouse died in 1990 has until October 28, 2011 to file an I-360).

These visas are drawn from countries with low rates of immigration to the U.S.
